As Salaam Allium,

My daughter has recently received a proposal. The guy has done his MPA and M.COM (insurance) from KU and works at Marsh & McLennan, Karachi as an Account Executive. This organization offers risk management and insurance brokerage services to clients globally.

According to him, he is responsible for risk management and helping two or more clients get in touch with one another so they can form mutually beneficial relationships. He states that his salary isn't paid by the insurance company rather it is paid by his company for the work that he does. He claims that he knows insurance is haram and hasn't taken out insurance on anything even his car.

In the light of all this, I would like to request you to advise us whether his source of income and livelihood is halal or haram? As this would help us make a decision.

It would be helpful if we could be provided with a fatwa within 3 to 4 days as we have to get back with an answer to the guy's family،Looking forward to your response.                                                          

اَلجَوَابْ بِاسْمِ مُلْہِمِ الصَّوَابْ

In this case the source of income of this guy is haraam, so his salary is also haraam, because he provides assistance in works of sin. The Holy Qur'an instructs us not to help anyone in committing sins. The Prophet (peace be upon him) cursed the one who consumes usury, the one who pays it, the one who writes it, and those who witness it. ”He said: They are equal in sin. The salary he receives will be in return for the services he provide to the insurance company, and according to the sharia’h if the work is pure but not halal, the salary is not halal so. Therefore, He should refrain from working in this company and arrange a job for his self in a halal company.

 It is appropriate to deny the relationship for this reason, that the guy works for an insurance company but if he assures that he will continue to work hard for a halal job or business, then it is right to have a relationship with him. And it will be necessary for him to fulfill this promise.

{وَتَعَاوَنُوا عَلَى الْبِرِّ1 وَالتَّقْوَى وَلا تَعَاوَنُوا عَلَى الأِثْمِ2 وَالْعُدْوَانِ}أمرهم تعالى بالتعاون على البر والتقوى، أي: على أداء الواجبات والفضائل، وترك المحرمات والرذائل، ونهاهم عن التعاون عن ضدها، فقال عز وجل: {وَتَعَاوَنُوا عَلَى الْبِرّ وَالتَّقْوَى وَلا تَعَاوَنُوا عَلَى الأِثْمِ وَالْعُدْوَانِ} .

{ يَاأَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ فَاجْتَنِبُوهُ لَعَلَّكُمْ تُفْلِحُونَ (90) }

[يَاأَيُّهَا الَّذِينَ آمَنُوا لَا تَأْكُلُوا أَمْوَالَكُمْ بَيْنَكُمْ بِالْبَاطِل] ففي هذه الآية ( 29 ) ينادي الله تعالى عباده المؤمنين بعنوان الإِيمان فيقول : { يا أيها الذين آمنوا } وينهاهم عن أكل أموالهم بينهم بالباطل بالسرقة أو الغش أو القمار أو الربا وما إلى ذلك من وجوه التحريم العديدة فيقول : { لا تأكلوا أموالكم بينكم بالباطل } ، أي بغير عوض مباح ، أو طيب نفس..فمن هداية الآيتين ..حرمة مال المسلم ، وكل مال حرام وسواء حازه بسرقة أو غش أو قمار أو ربا .

صحيح مسلم (3/ 1219)عن جابر، قال: «لعن رسول الله صلى الله عليه وسلم آكل الربا، ومؤكله، وكاتبه،وشاهديه»، وقال:«هم سواء» ،قال القرطبي۔۔ وکاتبہ: الذي یکتب وثیقتہ، وشاھداہ: من یتحمل الشھادة بعقدہ وإن لم یوٴدھا، وفي معناہ: من حضر فأقرہ, والمراد بالکاتب کاتب الوثیقة وبالشاھد المتحمل وإن لم یوٴد، وفي معناھما من حضر فأقرہ.
