سوال
Ethically or Islamically, can my mother keep her brother’s name in Next of Kin under her bank account?
اَلجَوَابْ بِاسْمِ مُلْہِمِ الصَّوَابْ
In Islamic law, there is no specific rule about naming a "next of kin," even though this term is often used in bank accounts and property papers. Naming someone as "next of kin" does not take away the rights of the legal heirs. According to Islamic inheritance laws, a deceased person's property must be divided fairly among all rightful heirs.
So, if your mother has listed her brother as her "next of kin" for practical reasons, it does not change the legal distribution of inheritance, which must follow Islamic rules.
