سوال

It has been reported one of my close relative person was involved in bisexual activities now he is in abroad what is fatwa for him ?

اَلجَوَابْ بِاسْمِ مُلْہِمِ الصَّوَابْ

Islam is a primordial religion (Dīn al-Fiṭrah). Following Islamic teachings guarantees the purity (پاکیزگی) of human society. Allah Almighty has prescribed the sacred and permissible (Halāl) path of marriage (Nikah) for fulfilling human desires and sexual needs, allowing a man to marry up to four women. In contrast, fornication/adultery (Zinā) is categorized as a major sin (Kabīrah Gunāh) and an act of shamelessness (Fāḥishah).

Homosexuality/Bisexuality is considered even worse than Zinā. it is an extremely reprehensible (Shani') and unnatural act that equates to fighting against nature (Fitrat).It is unimaginable for a person of sound nature. It leads to human depopulation and the destruction of the family system and the lineage of humanity, which is why the Quran and Sunnah severely condemn it.

There are severe warnings (Wa'īd) against this deed in the blessed Ahadith. The Prophet (PBUH) stated that ruin will descend upon his Ummah, when six sins become acceptable in society, including men seeking sexual gratification (Taskeen) with men, and women with women.

The severity and repulsiveness of this crime in the Shariah are evident from the severe punishments prescribed for it, such as throwing the perpetrator from a high place or a mountain, followed by stoning, to make them a lesson for others. However, only the government can execute these penalties (Tazir) after fair trial. The general public or relatives do not possess the right to enforce them.

If the Almighty Allah has kept the person’s sin hidden and he is not yet under the grip of the law, it is for him to immediately seek forgiveness (Istighfār) from Allah with sincere repentance (Tawbah-e-Naṣūḥ) and make a firm promise to avoid this act at all costs in the future. He needs to confess (Iqrar) his crime, and turn himself in to face the law. Inshā'Allāh, Allah is the Most Forgiving One.

If someone directly sees this sin being committed as an eyewitness (Shahid), they have the right to testify in court. This helps remove such evils from society and serves as a deterrent (Ibrat) to others. However, if they choose to keep the matter private (Satr) to protect their brother's reputation, this is also allowed and is even preferred (afzal) in Islam. In either case, it is the moral duty of every Muslim to do their best to improve society (Islah) and discourage evil (Nahy 'an al-Munkar) based on their abilities. Their action should be limited to advising the person wisely and gently, and this advice must only be given in private (Khilwah). Publicizing the sin or causing disgrace is strictly forbidden.

Since the individual is residing abroad and the family is not in a position to exert compulsion (Jabr), the Shari'ah guides you to approach the matter with wisdom and love. Inform him about the destruction in this world and the Hereafter caused by this act and encourage him toward a pure life. Advise him to stay away from bad company and environments that tempt him toward this sin. Efforts should be made for him to spend time with righteous people, scholars, or the local Tablighi Jamā'at, as good companionship profoundly changes a person. Assure him that the door of Allah's mercy is still open. If he repents sincerely and abandons this act, Allah will forgive him. Make earnest supplications (Du'ā) to Allah for him, crying out to the Almighty to purify his heart from the filth of sins and grant him a modest life according to the Sunnah.

In summary, the final message is to bear the strongest aversion (I’raz) toward this act while making every possible effort to pull your Muslim brother out of this mire (Rijis/Filth) of sin, because true success is achieving salvation from the Hellfire.

حدثنا أبو سعيد الأشج ، حدثنا أبو خالد الأحمر ، عن الضحاك بن عثمان ، عن مخرمة بن سليمان ، عن كريب ، عن ابن عباس ، قال : قال رسول الله صلى الله عليه وسلم : " لا ينظر الله إلى رجل ، أتى رجلا أو امرأة في الدبر " . قال أبو عيسى : هذا حديث حسن غريب وروى وكيع هذا الحديث .

والشهادة في الحدود يخير فيها الشاهد بين الستر والإظهار، والستر أفضل، إلا أنه يجب أن يشهد بالمال في السرقة فيقول: "أخذ"، ولا يقول: "سرق".

ولو وطئ امرأة في دبرها أو لاط بغلام لم يحد عند أبي حنيفة رحمه الله تعالى ويعزر، ويودع في السجن حتى يتوب، وعندهما يحد حد الزنا فيجلد إن لم يكن محصناً ويرجم إن كان محصناً ولو فعل هذا بعبده أو أمته أو بزوجته بنكاح صحيح أو فاسد لا يحد إجماعاً كذا في الكافي، ولو اعتاد اللواطة قتله الإمام محصناً كان أو غير محصن كذا في فتح القدير.
