The divorce has taken place. Both the man and the woman were previously married. The man has a 16-year-old son from his first marriage, and the woman has three sons from her first marriage. One is almost 18 years old, and the other two are younger. She also has two daughters, one of whom is an adult. From this marriage, they now have a daughter who is currently 1 year and 4 months old. The woman has now decided to remarry, as she herself has stated. In this situation, who has the right to the custody of the daughter?

اَلجَوَابْ بِاسْمِ مُلْہِمِ الصَّوَابْ

The person whom she wants to marry, if he is her daughter’s Dhi-Rhim Mahram (A person with whom marriage is not allowed forever due to the kinship, such as a paternal uncle and so on), then the mother has the right to the custody until puberty. After puberty, if she is mature, she has the choice to live with either parent. But if that person is not her daughter’s Dhi-Rhim Mahram, then the right to the custody goes to the maternal grandmother, paternal grandmother, respectively.

الدر المختار وحاشية ابن عابدين (رد المحتار) (3/ 555):

الحضانة: بفتح الحاء وكسرها: تربية الولد.(تثبت للأم) النسبية (ولو) كتابية، أو مجوسية أو (بعد الفرقة) (إلا أن تكون مرتدة) ... (أو متزوجة بغير محرم) الصغير.

 (قوله: بغير محرم) أي من جهة الرحم فلو كان محرما غير رحم كالعم رضاعا، أو رحما من النسب محرما من الرضاع كابن عمه نسبا هو عمه رضاعا فهو كالأجنبي.

الدر المختار وحاشية ابن عابدين (رد المحتار) (3/ 562):

(ثم) أي بعد الأم بأن ماتت، أو لم تقبل أو أسقطت حقها أو تزوجت بأجنبي (أم الأم) وإن علت عند عدم أهلية القربى (ثم أم الأب وإن علت) بالشرط المذكور .
