It should be noted that, in today’s market, various digital platforms and channels are used for the transfer of money and other financial transactions. These platforms facilitate customers in transferring and receiving money, as well as availing themselves of certain other financial services. Examples include banks’ digital applications, ATMs, Easypaisa, JazzCash, and similar services. A specific fee is generally charged to customers for such services. In principle, this fee is charged as remuneration (ujrah/service fee) for the service provided, rather than as an increase stipulated on a loan. Therefore, a fee charged merely in consideration of a money transfer or other permissible financial service does not, in Shariah terminology, constitute riba, provided that it does not involve any impermissible condition or other Shariah violation.

Accordingly, banks and other digital payment platforms are permitted to charge a service fee for money transfers carried out through their digital applications, ATMs, or other electronic channels, as such charges are levied in consideration of the services provided and do not constitute riba.

However, with regard to services such as Easypaisa and JazzCash that are provided through shopkeepers or retailers, there is some detail, which depends on the nature of the account and the contractual relationship between the company and the retailer. This is explained below:

A: Retailer Account

From a Shariah perspective, an Ijarah (contract of hiring) is concluded between the company and the retailer in the case of a Retailer Account. Under this arrangement, the retailer performs services on behalf of the company and receives a specified commission from the company. The company prohibits the retailer from charging the customer any additional amount.

Therefore, both parties are required to comply with the permissible terms and conditions stipulated in the Ijarah agreement. Accordingly, in his capacity as the company’s commission agent, the retailer is not permitted to charge the customer any additional amount for transferring or depositing money.

B: Personal Account

In the case of a Personal Account, the retailer does not act as the company’s commission agent. Therefore, the company does not pay him any commission for transferring money. Rather, the company merely permits him, by way of Tabarru‘ (gratuitous concession), to use its system. Furthermore, the company does not prohibit the account holder from providing services to other individuals through the Personal Account; rather, he is independently authorized to provide such services to anyone at his discretion.

Accordingly, when a retailer transfers a customer’s money through his Personal Account, a separate Ijarah contract is concluded between the retailer and the customer, under which the retailer acts as an Ajeer (employee/service provider) of the customer and provides the relevant service to him. Therefore, the retailer is permitted to charge the customer a reasonable additional amount as Ujrah (remuneration/service fee) for transferring money through his Personal Account, provided that the customer is aware that such additional amount is being charged by the retailer as remuneration for the service rendered by him.
